Terms of Service

The agreement between you and CellarPals — what you can expect from us, and what we ask of you in return.

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of CellarPals (“CellarPals”, “we”, “us”), a web and mobile application for cataloguing personal wine and spirits collections. By creating an account or using the service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use CellarPals.

2. Eligibility

CellarPals is intended for adults of legal drinking age in their jurisdiction and is not directed to anyone under 18. By using the service you represent that you meet this requirement. CellarPals is a record-keeping tool; it does not sell, ship, or supply alcohol.

3. Your account

You are responsible for the activity under your account and for keeping your credentials secure. Provide accurate information and notify us of any unauthorized use. You may sign in with email or a supported third-party provider (Google, Facebook); their terms also apply to that sign-in.

4. Subscriptions, trials & gift certificates

  • New accounts include a 14-day free trial (no card required). After the trial, continued editing requires a paid subscription; your data is never deleted for non-payment (see “Read-only on lapse” below).
  • Paid plans are billed monthly ($12.99) or yearly ($119.99) — on the web via our payment processor (Stripe), and in the mobile apps via your App Store / Google Play account — and renew automatically until cancelled. Prices may change on renewal with notice.
  • You can cancel anytime; access continues until the end of the paid period. Except where required by law, payments are non-refundable.
  • Gift certificates add free access for their stated duration, are single-use, non-transferable once redeemed, and carry no cash value.
  • Read-only on lapse: if a subscription lapses, the account becomes read-only — you keep full access to view and export your data, but adding or editing requires an active subscription.

5. Acceptable use

You agree not to:

  • break the law or infringe others’ rights;
  • upload content that is unlawful, or that contains other people’s personal information without permission;
  • attempt to breach security, access other users’ data, disrupt the service, or probe/scan our systems without authorization;
  • abuse, overload, or reverse-engineer the service, or resell it without our consent.

6. Your content

You retain ownership of the data you add (your collection, notes, photos). You grant us the limited licence needed to host, process, and display it to operate the service for you. You are responsible for your content and for keeping your own backups (the app provides export at any time).

7. AI-generated content

CellarPals can generate tasting assessments, recommendations, and label recognition using AI. These are automated, best-effort estimates that may be inaccurate or incomplete and are provided for convenience only — not professional, medical, or purchasing advice. Use your own judgement.

8. Third-party services

CellarPals relies on third parties to operate (for example Supabase for hosting/auth, Stripe for payments, Anthropic for AI). Your use of the service may be subject to their terms, and we are not responsible for third-party services.

9. Intellectual property

CellarPals, its name, and its software and design are owned by us and protected by law. These Terms grant you a personal, non-exclusive, non-transferable right to use the service; no other rights are granted.

10. Disclaimers

The service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or that valuations, data, or AI output will be accurate.

11. Limitation of liability

To the fullest extent permitted by law, CellarPals will not be liable for indirect, incidental, special, or consequential damages, or for loss of data, profits, or goodwill. Our total liability for any claim relating to the service will not exceed the amount you paid us in the 12 months before the claim.

12. Termination

You may stop using the service and delete your account at any time (Account settings). We may suspend or terminate access if you breach these Terms or to protect the service and its users. You can export your data before deleting; after deletion, data is removed per our Privacy Policy.

13. Changes to these Terms

We may update these Terms from time to time. We will post the new version here and update the date above; material changes may be noted in the app. Continued use after changes means you accept them.
